1. Subject of the Contract

These General Terms and Conditions govern the contractual relationship between the company Inkolor.ch GmbH (hereinafter referred to as the company) and the buyer of goods and services from the company's online shop.

2. Scope and Validity

The present GTC regulate the rights and obligations in the relationship between the company and its customers. They apply to all business relationships between the company and the customers, especially for the delivery of products and the provision of services, unless otherwise agreed in writing.
Changes will be announced to the customer on the company's homepage. Products are products and services offered and distributed by the company.

3. Conclusion of the Contract

The offer and prices are valid only for Switzerland and the Principality of Liechtenstein. The contract is concluded with the acceptance of the customer's order by the company. The company informs the customer about the acceptance of the order via email. Providing a valid email address is the responsibility of the customer.
The products and services published on the internet at www.inkolor.ch are considered a binding offer. However, this offer is always subject to the (resolving) condition of delivery impossibility or an incorrect price indication. The contract is concluded as soon as the customer orders using the pre-formulated form on the internet and it arrives at the company. The arrival of the order at the company is indicated to the customer by means of an automatically generated order confirmation. However, if one of the above-mentioned (resolving) conditions occurs, the contract is immediately dissolved without the involvement of the parties. The customer will be informed immediately by the company.

4. Prices

The prices of the products and services are purely net in Swiss francs including VAT. Delivery costs and packaging are invoiced separately. All items are displayed to the customer before sending the order in the online shop.

5. Delivery Conditions

The delivery can be made by the company or third parties. The company decides on the type of delivery. Orders received Monday to Friday before 4:30 PM will be shipped the same day. If the customer chooses the "Express" shipping option, delivery will be made the next day (Monday-Saturday) before 9 AM. If the customer chooses the "A-Post" shipping option, delivery will be made the next working day. If the customer chooses the "B-Post" shipping option, delivery will be made within 2 working days.
If the customer chooses the "Prepayment" payment method, the delivery times apply from receipt of payment.
If an item is not in stock and delivery may be delayed, the customer will be informed before purchase in the online shop.
However, due to unexpected production or delivery bottlenecks, delivery delays may occur. All information on availability and delivery time is therefore without guarantee and can change at any time.

6. Duty to Inspect

The customer must immediately check delivered or collected products for accuracy, completeness, and delivery damage.
Delivery damage, incorrect and Incomplete deliveries must be reported within 5 calendar days from the time of collection or delivery. Such a product must not be put into operation by the customer and must be kept in its original packaging as received.

7. Payment Terms

Payments must be made in Swiss Francs. The company offers the following payment options:

    • Credit card (Visa, Mastercard, AmericanExpress)
    • Twint
    • PostFinance E-Finance, Pay and Card
    • PayPal
    • Invoice (only for business customers after credit check)
    • Cash payment upon collection
    • Advance payment
  • If the customer chooses the payment method "advance payment", he must pay the entire invoice amount within two weeks. After this period, the purchase contract becomes void.

8. Retention of Title

Ordered products remain the property of the company until full payment is made. The company is entitled to make a corresponding entry in the retention of title register. Prior to the transfer of ownership, pledging, transfer by way of security, processing, or transformation without the express consent of the company is not permitted.

9. Return Policy

The customer has the right to return all items purchased in the company's online shop without stating reasons in the unopened original packaging and in unused, perfect condition within 30 days of receipt. The customer bears the cost of the return.
Before any return, a return number (RMA number) must be obtained from the company via email or phone. For returns without a valid RMA number, the company may refuse acceptance or return the goods unchecked and at the sender's expense.
In the case of a return, the contract is dissolved and credit for payments already made is issued minus the shipping costs after the returned goods are received.
If the goods show signs of use or damage upon return, the company reserves the right to assert claims for compensation.

10. Warranty and Liability

If an item purchased in the company's online shop does not function as expected, the customer has the right to return it to the company within 36 months from the purchase date, stating the reasons. The customer bears the cost of the return.
Before any return, a return number (RMA number) must be obtained from the company via email or phone. Please provide your customer and order number and describe the defect. For returns without a valid RMA number, the company may refuse acceptance or return the goods unchecked and at the sender's expense. The issuance of an RMA number does not constitute recognition of a defect or other complaints by the customer.
In the event of a return, credit or refund of payments already made or replacement of the item by the company occurs. The warranty expires if changes or repairs are made to the goods. For already used items, the company reserves the right to only provide a partial credit. As far as permitted by statutory provisions, liability for damages is excluded. In particular, the company is not liable for damages resulting from improper use or natural wear and tear, or for damages that did not occur to the delivery item itself (consequential damages).

11. Data Protection

The provisions of the Swiss Data Protection Act apply. Personal data is not made accessible to third parties.
The customer agrees to the processing of their data within the company and its use for internal marketing purposes. The customer has the right to access their stored personal data at any time, to correct or supplement their personal data, to object to the processing of their personal data, or to request the deletion of their personal data.
The customer is obliged to keep their access data confidential and not to disclose it to third parties. The company assumes no responsibility for damages incurred by the customer from the misuse of their access data. The online transmission of credit card information is encrypted with an SSL certificate, guaranteeing a secure payment method. The company does not store any credit card data.

12. Use of the Website

The content and structure of the company's website are protected by copyright. All rights are reserved. The distribution or modification of the website's content is not permitted and may not be copied or made accessible to third parties for commercial purposes without the prior written consent of the company. The information provided on the website is subject to continuous control and is constantly updated. Nevertheless, it is possible that data has changed despite careful checking. For this reason, the company assumes no liability or guarantee regarding the accuracy, completeness, and timeliness of the information provided on this website. This also applies to all websites referred to via hyperlink. The company is not liable for their content. Furthermore, the company reserves the right to change or supplement the information provided. All trade names and brands are the property of their respective owners and are used only for the description and identification of the products. The company is in no way affiliated with any manufacturer of original accessories for printers.

13. Applicable Law and Jurisdiction

The provisions of Swiss law apply. Swiss law is also applicable if the customer has a residence or registered office abroad. The place of jurisdiction for all claims in connection with contractual agreements with Inkolor.ch GmbH is Sarnen.
